Kaplan Morrell has recently led the way in amending the Colorado Workers' Compensation Act. With the assistance of the Workers' Compensation Education Association, Kaplan Morrell successfully advocated the right for adults to have both guardians and conservators at their aid if their work-related injury is extremely severe.
DENVER - ColoradoDesk -- COLORADO - Kaplan Morrell has recently led the way in amending the Colorado Workers' Compensation Act. With the assistance of the Workers' Compensation Education Association, Kaplan Morrell successfully advocated the right for adults to have both guardians and conservators at their aid if their work-related injury is extremely severe.
As a result of this legislative initiative, the 2021 amendment to the Act will serve terribly injured workers for the foreseeable future. Workers' compensation carriers are required to provide injured workers all reasonable, necessary and related medical care that cures or relieves the symptoms of the work-related condition.
"Prior to the law changing, only minors were afforded the right to have a guardian appointed by an Administrative Law Judge and have the workers compensation carrier pay for the same. The Colorado Workers' Compensation Act was silent as it related to adults who suffered severe work-related injuries needing both guardians and conservators."
