Legalhotwater secures FOIA victory after three (3) years of delays, stonewalling, and frivolous denials notwithstanding the statutory authorized release of documents.

COLORADO SPRINGS, Colo. - ColoradoDesk -- After three (3) years of litigation, delays, and subsequent appeals, Legalhotwater announces the release of records from the Federal Bureau of Investigation ("FBI") which is a component of the Department of Justice.

Freedom of Information Act ("FOIA") requests are a creature of statute which generally conclude without litigation in ninety days or less, albeit on occasions extending upwards of six (6) months or more. It is extremely rare, in fact unheard of, for a FOIA request to span three (3) years or more without any release from the obligatory party. Even JudicialWatch, which specializes in FOIA legal actions, rarely if ever has seen a three (3) year FOIA action without the production of any demanded records – even during the COVID-19 era.

Although many states were shutdown during the early stages of COVID-19, effectively COVID-19 became the tool of choice to evade the production of statutorily required producible records by the obligatory party. Even after 2022, the FBI, without basis, continued to refuse to produce the demanded records, which as a consequence resulted in at least three (3) climbs up the ladder to the Second Circuit Court of Appeals in New York City, NY. Notwithstanding the recent victory, in obtaining some of the demanded records withheld absent foundation, a few issues still remain. In any event, the treasure trove of records will be publicly released in the very near future on the Legalhotwater portal.
