Freedom of Information Act ("FOIA") requests are a creature of statute which generally conclude without litigation in ninety days or less, albeit on occasions extending upwards of six (6) months or more. It is extremely rare, in fact unheard of, for a FOIA request to span three (3) years or more without any release from the obligatory party. Even after 2022, the FBI, without basis, continued to refuse to produce the demanded records, which as a consequence resulted in at least three (3) climbs up the ladder to the Second Circuit Court of Appeals in New York City, NY. Notwithstanding the recent victory, in obtaining some of the demanded records withheld absent foundation, a few issues still remain.
